Victory in School Funding Suit
You've probably heard about the NEWS court decision, but may still have a few questions:
What is NEWS?
Network for Excellence in Washington Schools is an organization led by organizations like the Washington State PTA, the League of Women Voters, the Seattle Urban League, large and small school districts across our state and a broad base of other civic and education organizations. NEWS was formed when it became clear that action was needed to force the state to make good on its promise to each and every child in Washington. (Click here for a list of NEWS organizations.)
What was the main argument in the case?
The NEWS position was simple: Washington state has and does not live up to its constitutional duty that states, "It is the paramount duty of the state to make ample provision for the education of all children..." by failing to fully fund basic education.
What was the court's decision?
The court ruled that the state is not meetings its constitutional duty by simply funding a 'formula'. The court also defined basic education as "the knowledge and skills needed to compete in today's economy and meaningfully participate in the State's democracy." Sound familiar? It should, it reflects the Essential Learning Requirements and the 1992 education reform bill 1209. The court also directed the State to have real and measurable progress in the area of funding, though no time frame was given. The court further stated that the State cannot avoid its duty by stating they will comply in the future.
Won't the decision be appealed?
Probably, but there is a large group of legislators that have petitioned the Governor and the Attorney General to not appeal the decision. Email or phone your legislator and ask them to oppose any appeal of the decision and that they fulfill their Oath of Office (to uphold the state constitution) and fully fund education.
